It is Law Day, 2023. Thanks to those attorneys who, by their words and deeds, keep alive my oft-flickering belief that the practice of law is a profession, and not merely a business.

                                                                                                                                                                                              I use humor, current events, history and attendee participation to make my "Law with Laughter presentations an easy way for people to learn. Ed Asner, who died this week, did it in a different way: He bacame a terrific actor, and then used his popularity as a means to speak publicly on matter of importance to him. Of course, many celebrities use their notoriety to spout opinions on all sorts of matters. But Ed Asner was different. He took the time to learn about the issues important to him. As a result, he could support his opinions with facts and cogent arguments. We can all learn from Ed Asner: If you want to speak or write persuasively, first become knowledgeable about the subject. Then use whatever strengths you have to express yourself.

     Carroll Spinney died yesterday.  He was the man who brought us Big Bird and Oscar the Grouch on "Sesame Street."  I learned a lot from Spinney:  He demonstrated to me that, with the right approach, children (and, frankly, adults) could learn about difficult or confusing concepts if they were taught in a manner other than lecturing and teaching to the test.  It took little time for Spinney's distinct voices to get the viewer's attention, and for the viewer to recognize that behind the voice was a deep desire to connect on personal level.

     Legal concepts can be frustrating and confusing; but can be more easily and better understood when presented with humor and heart.

     I wish I had been thoughtful enough to thank Carroll Spinney before he died.  I guess K-Law just learned a lesson, too....

     I came across an online ad from the PA State Store to promote a certain red wine.  Actual quote:  "...with strong notes of...pencil lead...." (my italics).  This replaces my previous favorite, i.e., "...with hints of burnt toast and wet rock."  [Thanks, but I'll stick with vodka on the rocks.]

      "Crocodile Hunter" Steve Irwin would have been 57 yesterday.  One of my favorite Steve Irwin quotes is actually a credo of the K-Law method of teaching:  "I believe that education is all about being excited about something.  Seeing passion and enthusiasm helps push an educational message."

     K-Law will be presenting "Entity Identity" to 3rd year law students at the Widener University School of Law (Commonwealth Campus, in Harrisburg), on January 28.  I present Entity Identity to anyone interested in learning about the different types of business entities he or she can form to run a business.  It's fun to teach, because I can use examples from all sorts of businesses.  (Let's form a printing business and call it "Ink, Inc.")  It's more of a challenge to teach it to budding attorneys, because a) the examples will only deal with law firms, and b) some of the students  probably know more than I.  Fortunately, I'll have tax guy Seth Springer joining me.  (The only thing K-Law knows about tax law is that he doesn't know enough about tax law.)

       My presentation is part of a course jointly developed by the Pennsylvania Bar Association and the Widener University School of Law.  It's one of the first of its kind.  Kudos to Widener and the leaders of the PBA's Solo & Small Firm Section for bringing a program of practical information and use to students who have been sitting through a lot of courses dealing with legal theory over the past couple of years.

     Twenty years ago, Larry Page and Sergey Brin, who were collaborating on a research project, decided to form Googlas an entity.  Eight years later, the word "Google" became a recognized verb in the Merriam-Webster and Oxford English Dictionaries.  I can't help but wonder if Page and Brin, who were students at the time, used an attorney to do all of the things necessary to properly form an entity, or if they decided to try to "save a few bucks" and file something by themselves.  Did they understand the difference between a corporation and an LLC?  Did they think about what would happen if they disagreed on how the corporation would develop or if one of them died?  Did they think about whether a trademark registration would be a wise idea?  I would like to think that taking my Entity Identity course would have been of some help.  If you are thinking about starting a business, make sure you speak with an attorney and an accountant or financial advisor before you try to file something yourself.  Of course, attending a Law With Laughter session like Entity Identity or How to Keep the Money You Make will also save you some time and money--and have you smiling as well.

     The purpose of K-Law Productions is to provide Law With Laughter programs.  The programs are designed to teach people about the laws and legal concepts which affect their lives, while doing so in an entertaining manner.  The courses are humorous, interactive and designed to incorporate current events and "real life" issues; however, the programs are non-partisan and all-inclusive.  After all, regardless of who you are or what personal beliefs you hold dear, the law is the law and everyone can enjoy a good laugh.  Accordingly, I avoid using this website for social or political commentary.

     However, I must make an exception today:  That is because an attorney said something yesterday which is, at best, chilling, and at worst, an attack on the fundamental rule of law upon which this country is based:  The President's counsel stated that "Facts are in the eye of the beholder."  Unlike the bewildering "alternative facts" statement of a press secretary, this statement was made by an attorney.  Though some people have expressed their dismay at this statement, I believe every attorney--regardless of his or her social or political beliefs--has an obligation to clearly and forcefully dispute that comment.  Attorneys have a duty to find the truth, and to never obscure or hedge what they know the facts to be.  Facts don't change just because the attorney or the client may find them inconvenient or contrary to his or her position.  Facts are not in the eye of the beholder.  Facts are facts, regardless of the eye of the beholder.  Attorneys must not only acknowledge this, but must also publicly and unequivocally confront anyone--particularly another attorney--who would say otherwise.

     K-Law had a fantastic time being the Pronouncer and Judge at the Montgomery County Senior Spelling Bee on May 16, at the Montgomery County Senior Adult Activity Center, in Norristown.  1st and 2nd place finishers from local Bees throughout the County competed at MontCo S.A.A.C.  Michele Ross did a terrific job organizing the event, and the spellers were incredible.  It should come as no surprise that a retired teacher and a former legal secretary took top honors.  As a lawyer who teaches, I couldn't ask for a better result.

     February 18 is National Drink Wine Day in the U.S.  I believe that, in the future, we should change the date to February 13.  This will increase the probability that more people will be able to enjoy Valentine's Day on February 14.

     Maybe it is the fact that I am "follicly challenged" that earned me an invitation to speak at the Baldi Middle School earlier this month, but I would like to think that I was asked to speak because I had something to say which is worth hearing.  In any event, K-Law had a great time demonstrating to the students that learning how to effectively communicate can help you achieve your goals.  Whether you choose a career in science, law, medicine, art, engineering, technology or anything else, you have got to be able to understand what others are saying, and you have to learn how to have others understand you.  Thanks to Angelique Frazier and all of the students for a terrific time.

      I was honored to be invited to present "Simply Speaking", a communications program, to ninth grade STEM (Science, Technology, Engineering, Math) program students during the Chester County Futures day at West Chester University on 8/2/17.  I hope the students enjoyed the presentation as much as I enjoyed being with them.  The afternoon was interactive, fun and informative.      On May 23, I had a terrific time presenting Entity Identity to the Montgomery County Paralegal Association.  I am not certain whether the paralegals had as much fun as I, but I am certain that, after teaching the course, "Law With Laughter" is an apt description of what K-Law Productions is all about.

      Another surprise--this time from the Pennsylvania Bar Association:  At the PBA's Annual Award Luncheon on May 10, I received the 2017 Solo & Small Firm Section Award.  I traveled to Pittsburgh to accept the the award, which was presented to me by PBA President, Sara Austin, and Rita Alexyn, Chair of the Solo & Small Firm Award Committee.  The award was of particular significance because it was given to me for exemplifying the abilities of solo and small firm attorneys, and for sharing my knowledge in a non-traditional way with other Pennsylvania attorneys and citizens.

       Had a wonderful time with the Chester County Futures students at Kennett High School, presenting The Lawyer Stands Trial.  The students were terrific, playing the roles of lawyers, witnesses and jurors, as we tried to determine if lawyers are the protectors of rights, or guns for hire who will do anything to augment their profiles and their wallets.  We could all learn from young people who place a high value and a willingness to listen.

          Hans Rosling died today.  Hans was one of the first--and one of the best--"Edutainers."  He had a remarkable ability to explain difficult concepts by entertaining his audiences.  In short, what I have tried to do with K-Law Productions, i.e., teach a little law with a lot of laughter, Rosling successfully did on a much larger scale.  He helped thousands of people learn all sorts of complex subjects, using a variety of entertaining techniques.  I hope that my explaining and teaching of legal concepts through interactive and entertaining presentations, will do some justice to Rosling's legacy.

Ken writes on Law, Laughter and More

 

          I view our community not as a “melting pot,” but as a woven basket of innumerable strands.  Each strand has its own color and texture, which allows it to remain distinctive despite its being interlaced with thousands of other strands.  There are times when the strands of color and texture differ to such a degree, or are juxtaposed in such a way, as to draw our attention upon them.  The contrasts may make us uncomfortable at times, but what can we do?  To mute the colors would lessen the attractiveness of the basket; to smooth the textures would weaken the fibers and the basket’s strength; to remove the clashing spots would create a hole in the basket.

 

          I have come to the conclusion that, if we want the basket, we must accept it with all its contrasting features.  And we do want the basket: It holds our dreams.
